It protects the work under attorney work product, ensures the investigation serves the defense strategy rather than cutting across it, and keeps findings properly within the privileged relationship. Immediately, particularly for third-party video. Most commercial systems overwrite within one to four weeks, so preservation requests need to go out in days rather than after arraignment. This is the single most time-sensitive element of the case.
That does not resolve the legal questions. Whether the stop was lawful, whether testing was properly administered, and whether the evidence supports the specific charge are separate issues from whether alcohol was consumed. Investigation addresses the procedural and factual record.
